Uncontested
Uncontested residential non-judicial foreclosures are handled on a flat fee of $1000.00 in Memphis, Shelby County and an additional $100.00-$150.00 fee for any counties outside of Shelby.
Other costs and fees associated with foreclosure, other than attorney fees are typically:
- $12.00 for recordation of an Appointment of Substitute Trustee
- approximately $250.00 to $350.00 for typical publication expenses
- approximately $125.00 for last owners reference
- $13.00 to record Trustee's Deed, plus transfer tax of $3.70 per thousand
Contested
Contested residential foreclosures, commercial foreclosure work, and matters related to both residential and commercial foreclosures are typically performed on a non-contingent fee basis of $175.00 per hour.
Tennessee law
Tennessee law requires that we publish for three consecutive weeks and conduct the foreclosure sale eight days following the last day of publication. Therefore, it will take approximately five weeks from the date of commencement through the date of sale.
